That definition changes on November 12, 2026. Congress passed P.L. 119-37, which amends the statutory definition of hemp to a total-THC standard that includes THCA and excludes several categories of intoxicating hemp products. Products that no longer qualify are treated as marijuana under the Controlled Substances Act. A brand planning a Delta-9 gummy line should confirm its formula against the new total-THC measurement before committing to packaging and a launch date.
State law is a separate layer. Some states restrict or ban hemp-derived Delta-9 even where the federal definition allows it, so a brand must verify the rules in every state where the product will be sold.
